Last updated: 19 October 2026
OVERVIEW
This website is operated by Gleissner Pty Ltd (ABN 55 144 756 301, ACN 144 756 301), trading under the registered business name ELITE DANCER. Throughout the site, the terms “we”, “us” and “our” refer to Gleissner Pty Ltd trading as ELITE DANCER. ELITE DANCER offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services.
Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We may update these Terms as set out in Section 19.
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.
YOUR RIGHTS UNDER THE AUSTRALIAN CONSUMER LAW
Nothing in these Terms, our Refund Policy or our Shipping Policy excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded, restricted or modified (“Non-Excludable Rights”). Where a provision of these Terms would otherwise do so, it applies only to the extent permitted by law.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
SECTION 1 - ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or territory of residence, or that you are the age of majority in your state or territory of residence and you have given us your consent to allow any of your minor dependants to use this site.
You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A material breach of these Terms may result in suspension or termination of your access to the Service in accordance with Section 16.
SECTION 2 - GENERAL CONDITIONS
We may refuse access to the Service, or decline an order, where we have a reasonable basis for doing so (for example, suspected fraud, misuse of the Service, a breach of these Terms, or where we cannot supply the item). We will not do so on a basis that is unlawful. If we decline an order after you have paid, we will refund the amount paid for the affected items.
You understand that your content (not including credit card information) may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any content on the website through which the Service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
We take reasonable care to keep the information on this site accurate and up to date, but some general information (for example, articles, guides and historical information) may not be complete or current. General information on this site should not be relied upon as the sole basis for making decisions without seeking more specific advice where appropriate; you are welcome to contact us before you purchase. This section does not affect our obligations in relation to product descriptions, prices and other representations about the goods we sell, or your Non-Excludable Rights.
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site except as required by law.
SECTION 4 - MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products are subject to change without notice. A price change does not affect an order we have already accepted, except as set out in Section 11.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof).
Subject to your Non-Excludable Rights and to any order already accepted, we shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
SECTION 5 - PRODUCTS OR SERVICES (if applicable)
Certain products or Services may be available exclusively online through the website. These products or Services may have limited quantities. Change-of-mind returns and exchanges are offered according to our Refund Policy: https://www.elitedancer.au/policies/refund-policy. Those terms are in addition to, and do not limit, your Non-Excludable Rights.
We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at any time, but changes do not affect orders we have already accepted. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited.
Our products come with the consumer guarantees described above. Apart from those guarantees and any express warranty we give, we do not promise that a product will suit your personal preferences (for example, a size, fit or style that matches our description but that you choose not to keep). Our Dance Shoe Sizing Guide and our Refund Policy explain how we can help.
SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We may refuse or cancel an order on a reasonable basis (see Section 2). We may limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. If we change or cancel an order, we will notify you using the email and/or billing address/phone number provided at the time the order was made, and we will refund the amount paid for any items we do not supply. Orders placed for resale or by trade customers (for example, dealers, resellers, distributors and dance studios) may be subject to separate written terms agreed with us.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
For more details, please review our Refund Policy: https://www.elitedancer.au/policies/refundpolicy.
SECTION 7 - OPTIONAL TOOLS
We may provide you with access to third-party tools that we do not monitor and over which we have no control or input.
You acknowledge and agree that, to the extent permitted by law, we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. Subject to your Non-Excludable Rights, we shall have no liability arising from or relating to your use of optional third-party tools.
Any use by you of the optional tools offered through the site is at your own discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new Services and/or features through the website (including the release of new tools and resources). Such new features and/or Services shall also be subject to these Terms of Service.
SECTION 8 - THIRD-PARTY LINKS
Certain content, products and Services available via our Service may include materials from third parties.
Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and, subject to your Non-Excludable Rights, we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or Services of third parties.
Subject to your Non-Excludable Rights, we are not liable for any harm or damages related to the purchase or use of goods, Services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third party’s policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third party. This section does not apply to products you buy from us.
SECTION 9 - USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS
If, at our request, you send certain specific submissions (for example contest entries) or without a request from us, you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, “comments”), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.
We may, but have no obligation to, monitor, edit or remove content that we reasonably determine to be unlawful, offensive, threatening, defamatory, pornographic, obscene or otherwise objectionable or that violates any party’s intellectual property or these Terms of Service.
You agree that your comments will not violate any right of any third party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain defamatory or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments. You are responsible for any comments you make and their accuracy. Subject to your Non-Excludable Rights, we take no responsibility and assume no liability for any comments posted by you or any third party.
SECTION 10 - PERSONAL INFORMATION AND MARKETING CHOICES
Our collection, use and disclosure of personal information is explained in our Privacy Policy, including the section on marketing, advertising and your choices.
Creating an account, signing in, purchasing, submitting an enquiry or accepting these Terms does not, by itself, subscribe you to marketing or provide consent to personalised advertising. Optional subscriptions and any required advertising or data-sharing consents are explained when requested. Consent to one channel or purpose does not automatically extend to another.
You can change your choices using the options described in our Privacy Policy. Necessary, nonpromotional order and account communications can continue. New services and changes to these Terms do not override your choices or any requirement to obtain additional consent.
SECTION 11 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information. If an order is affected by an error of this kind (including after you have submitted your order), we will contact you and you may choose to proceed on the corrected basis or to cancel; if the order is cancelled, we will refund the amount paid for the affected items.
We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website should be taken to indicate that all information in the Service or on any related website has been modified or updated.
SECTION 12 - PROHIBITED USES
In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, Commonwealth, state or territory, or local laws, regulations or rules; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We may suspend or terminate your use of the Service or any related website for violating any of the prohibited uses, in accordance with Section 16.
SECTION 13 - WARRANTIES AND LIMITATION OF LIABILITY
13.1 Website availability. We use reasonable efforts to keep the website available and secure, but we do not guarantee that your use of the website will be uninterrupted, timely, secure or error-free. We may suspend or withdraw the website, or part of it, for maintenance, security or business reasons; where reasonably practicable we will give notice. This does not affect any order we have already accepted.
13.2 Consumer guarantees. If you acquire goods from us as a “consumer” under the Australian Consumer Law, our goods come with the consumer guarantees and you have the Non-Excludable Rights described under “Your rights under the Australian Consumer Law” above. How to make a claim for a faulty, damaged or incorrect item is set out in our Refund Policy.
13.3 Other warranties. To the extent permitted by law, and except for your Non-Excludable Rights and any express warranty we give in writing, all other warranties, representations and conditions (whether express or implied) are excluded.
13.4 Limitation of liability. To the extent permitted by law, and subject always to your NonExcludable Rights, ELITE DANCER is not liable to you for any loss or damage that was not reasonably foreseeable, or that is caused by your breach of these Terms, by misuse of a product or by an independent act or event outside our reasonable control. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud.
13.5 Business purchases. If you acquire goods from us for business purposes:
(a) where the goods are not of a kind ordinarily acquired for personal, domestic or household use or consumption, our liability for a failure to comply with a consumer guarantee (other than a guarantee under sections 51, 52 or 53 of the Australian Consumer Law) is limited, at our option, to replacing the goods or supplying equivalent goods, repairing the goods, paying the cost of replacing the goods or of acquiring equivalent goods, or paying the cost of having the goods repaired, unless it is not fair or reasonable for us to rely on this limitation (section 64A of the Australian Consumer Law); and
(b) where the consumer guarantees do not apply (for example, goods acquired for resale), to the extent permitted by law our total liability in connection with an order is limited to the price paid for the goods concerned, and we are not liable for loss of profit, revenue or business opportunity, or for indirect or consequential loss.
SECTION 14 - INDEMNIFICATION
You agree to indemnify ELITE DANCER for any loss, cost (including reasonable legal costs) or liability we reasonably incur as a result of a claim by a third party, to the extent caused by your breach of these Terms of Service or the documents they incorporate by reference, your violation of any law, or your infringement of the rights of a third party. Your liability under this indemnity is reduced to the extent that the loss was caused or contributed to by us, our employees or our agents. This section does not limit your Non-Excludable Rights.
SECTION 15 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service; such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 16 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If we reasonably believe that you have materially breached these Terms of Service, we may suspend or terminate your access to our Services (or any part thereof). Where reasonably practicable, we will notify you first. You will remain liable for amounts properly due up to the date of termination, and we will refund any amount you have paid for goods we will not supply. Termination does not affect your Non-Excludable Rights in relation to goods already supplied.
SECTION 17 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and the policies referred to in them (including our Refund Policy, Shipping Policy and Privacy Policy) constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior versions of the Terms of Service. Nothing in this section excludes or limits your Non-Excludable Rights or our responsibility for representations we make about our products.
SECTION 18 - GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Victoria, Australia, and the Commonwealth laws of Australia applying there. You and we submit to the non-exclusive jurisdiction of the courts and tribunals of Victoria. This does not deprive you of the protection of any mandatory consumer laws that apply to you where you live.
SECTION 19 - CHANGES TO TERMS OF SERVICE
You can review the most current version of the Terms of Service at any time on this page.
We may update these Terms of Service from time to time to reflect changes in the law, our products, our business or how the Service operates. Updated Terms will be posted on this page with the date of the update and will apply to your use of the website and to orders placed after that date. Changes will not apply to an order you placed before the update.
